New Trial Granted in Upshaw v Stephenson.
On July 14, 2022, Federal Judge Linda V. Parker ordered a new trial for Lafayette Upshaw because his trial attorney failed to present the testimony of his aunt at trial that he was home with her when the crime occurred. Judge Parker also ruled that the Wayne County Prosecutor engaged in racial discrimination during Jury selection. Judge Parker agreed with the arguments made in briefs both before and after David L. Moffit's passing. Judge Parker also relied on the performance of the firm's managing attorney, Tameka L. Tucker, who brought this victory home by brilliantly conducting the evidentiary hearing held in this case in May of this year.
